This session will examine issues arising from efforts to obtain medical exemptions from vaccination. Matters covered will include:
- Compliance with the Americans with Disabilities Act/Americans Disabilities Amendments Act, Rehabilitation Act on 1973, and EEOC Guidance.
- Legal duties of physicians in determining whether a patient should receive a medical exemption.
- Consequences of providing unwarranted medical exemptions.
- Question of the degree to which natural immunity to a vaccine-preventable disease asserted to have been acquired through infection with the disease should constitute a basis for a medical exemption.
